After a plebiscite on 20.03.1921 that was to decide on the shape of Polish–German border in Upper Silesia and indicated that Modzurów would remain in German did not leave despite constant harassment his parish. Murdered by a German gang during an attack on his rectory after III Silesian Uprising in 1921 when was then border dispute was finally settled.
